Eligibility Criteria for an LMIA-Based Work Permit

This process involves requirements for both the employer and the foreign worker. The burden of proof rests heavily on the employer to satisfy the government’s requirements.

For the Employer:

  • Advertising: The employer must conduct extensive recruitment efforts to find a Canadian or permanent resident. This typically involves posting the job on multiple platforms for at least four consecutive weeks.
  • Positive LMIA: The employer must apply to ESDC and receive a positive LMIA confirmation letter. This letter proves that hiring a foreign worker will have a neutral or positive effect on the Canadian labour market.
  • Genuine Job Offer: The employer must provide a formal, written job offer that meets provincial labour standards regarding wages, working conditions, and duties.

 

For the Foreign Worker:

  • Qualifications: You must prove that you have the skills, education, and work experience required for the job as outlined in the job offer and LMIA application.
  • Admissibility: You must be admissible to Canada. This means you must be in good health, have no serious criminal record, and satisfy an immigration officer that you will leave Canada when your work permit expires.
  • Intent: You must demonstrate to the officer that you intend to work only for the employer specified on the work permit.

The Application Process: From Job Offer to Work Permit

The LMIA process is a two-part journey, starting with the employer and finishing with the worker.

The Employer Applies for an LMIA
The employer gathers proof of their recruitment efforts, prepares a detailed application explaining the need for a foreign worker, and submits it to ESDC. This is the longest and most complex part of the process.
Receive the Positive LMIA
If ESDC is satisfied, they will issue a positive LMIA confirmation letter to the employer. This letter contains a unique number that the foreign worker needs for their application.
The Worker Applies for a Work Permit
With the positive LMIA and a formal job offer, you can now apply for your work permit. You will need to complete the application forms and provide your personal documents, including: A copy of your passport. Proof of your qualifications (diplomas, reference letters). The job offer letter and a copy of the LMIA confirmation.
Biometrics and Approval
You will submit your application online and will likely be required to give biometrics (fingerprints and a photo). Once your application is approved, you will receive a Port of Entry (POE) Letter of Introduction.
Arriving in Canada
You present your POE letter and passport to a border services officer upon arrival in Canada. The officer will make the final decision and issue your official work permit document.

Key Considerations for LMIA-Based Work

  • Employer-Specific: This work permit is not open. You are only authorized to work for the employer listed on the permit. If you want to change jobs, you will generally need a new work permit supported by a new LMIA.
  • Compliance is Crucial: Both you and your employer must respect the conditions of the LMIA and the work permit. The wage and duties must match what was approved. Failure to comply can result in penalties for the employer and the loss of your status.
  • Pathway to Permanent Residence: A valid job offer supported by an LMIA is a significant advantage when applying for permanent residence through Express Entry or Provincial Nominee Programs.
